Terms and conditions Atelier De Heerlijkheid

These terms and conditions apply to courses, workshops, other activities, shop and webshop sales and accommodation (B&B) of Atelier De Heerlijkheid (hereinafter: "ADH") and take effect from 18 November 2025.

Article 1 – Scope and Definitions1.0 Scope
These general terms and conditions apply to agreements between ADH and (a) participants in courses and workshops, (b) customers of the shop and webshop, and (c) guests who book accommodation (B&B), unless expressly agreed otherwise.
1.1 Course: a defined series of art lessons. A course may start at various points during a season and has a variable duration.
1.2 Workshop: a combination of enrichment and deepening in art/culture and the practical application of acquired knowledge within a relatively short period.
1.3 The Children's Art Studio: A course specifically for children aged 6 to 12.
1.4 Participant/student (hereinafter: "participant"): the natural person who is registered and placed in a course offered by ADH.
1.5 Person liable for payment: the person who owes the course fee. If the participant has not yet reached the age of 18 at the start of the course, the fee is owed by their legal representative, such as a parent, guardian, carer, association or institution.
1.6 Course fee: the amount the participant owes ADH for attending a course offered by ADH. The course fee is determined biannually prior to a short-term course.
1.7 Arrangement/activity: a guided tour, presentation, group arrangement and/or event offered by ADH, with or without catering (such as lunch, high tea or similar refreshments), whether or not customised, on a fixed date and time.
1.8 Booker/contact person: the natural person or legal entity who books the arrangement and acts as the point of contact for ADH. The booker is responsible for providing correct and timely information on behalf of the group.

Article 2 – Registration for a course at Atelier De Heerlijkheid
2.1 Registration takes place via the registration function on the website. If this function is not available, registration is done by email to bij@atelierdeheerlijkheid.nl.
2.2 ADH may refuse a registration without stating reasons.
2.3 All prices and content listed on the website, in brochures and other media are subject to (price) changes and typographical errors.

Article 3 – Placement
3.1 If placement is immediately possible, the registered participant will be notified.
3.2 If there is no available place at the time of registration, the registered participant will be informed that they may be placed on a waiting list by mutual agreement.
3.3 Once placement becomes possible at a later date, the registered participant will be notified.
3.4 If there are insufficient registrations for an activity, ADH has the option to reschedule or cancel the course/workshop.

Article 4 – Conclusion and duration of agreement for courses and workshops
4.1 A legally binding agreement between ADH and the participant is established once the participant has registered and paid.
4.2 Payment of the course/workshop fee by the participant, or the person liable for payment, is processed via a payment request no later than 14 days before the start of the course/workshop.
4.3 In the case of mid-term registrations, the agreement is entered into for the remaining duration of the course in the current season.

Article 5 – Workshop/course fee due
5.1 The workshop/course fee due is determined on the basis of the chosen workshop/course, the course duration and any material costs.
5.2 In the case of mid-term placement, the course fee is calculated proportionally to the number of remaining lessons.
5.3 Material costs are not included in the course fee, with the exception of the Children's Art Studio. For workshops, material costs may or may not be included depending on the type of workshop. This is always clearly communicated.

Article 6 – Payment of course fee
6.1 Payment of the workshop/course fee due is made either directly upon booking or after receipt of a payment request. Amounts are paid in full; if this is inconvenient for a participant, a suitable arrangement can be discussed.
6.2 All costs arising from late payment of the workshop/course fee are borne by the person liable for payment. This includes any income lost by ADH for lessons/workshops for which the participant registered but did not attend.
6.3 Cancellation of a course or workshop is possible up to 4 weeks before the start date. The full course fee will be refunded minus EUR 25 administration costs. If cancellation occurs between 2 and 4 weeks before the start, 50% of the registration fee will be refunded. If cancellation occurs within 2 weeks of the start date, no refund is due.
6.4 If payment of the course fee has not been made on time, ADH is entitled to suspend or terminate the provision of the course to the participant with immediate effect. The participant, or the person liable for payment, remains liable for the course fees even if they were not present during the lessons/workshop.

Article 7 – Termination of the agreement
7.1 The agreement is automatically terminated at the end of the season.
7.2 Mid-term cancellation is in principle not possible for courses of fewer than 18 lessons.
7.3 Mid-term cancellation is possible in the case of prolonged illness. The student/participant who wishes to qualify for this must submit a written request. The date of receipt of the request for de-registration applies as the de-registration date.
7.4 Termination of the agreement by ADH may take effect immediately if there are compelling reasons such as misconduct by the participant. In such cases, no right to a refund of paid course fees arises.

Article 8 – Provisions in case of cancelled lessons
8.1 In the event of cancelled lessons, the following applies:
8.1.1 ADH is always entitled to offer an alternative for cancelled lessons that meets the following conditions:
a. The alternative includes a lesson (or lessons) of at least the same duration.
b. The alternative may include (joining) lessons at another time.
c. The alternative may extend the period during which the course is given.
d. The alternative may be an enriching activity that, in terms of teacher effort and knowledge gained after participation, adds value to the art lessons normally enjoyed at De Heerlijkheid.
8.1.2 If more than 4 lessons are cancelled in a consecutive chronological series, the participant has the option to (temporarily) suspend the lessons. A refund of the course fee will only be made if ADH has been unable to offer an alternative under these conditions from the 5th cancelled lesson onwards.
8.2 If lesson cancellation is known in advance (at least 2 working days before the lesson), ADH will notify the participant, or the person liable for payment, by email. ADH is never liable for the non-reading or non-receipt of these messages, nor for any consequential damages.
8.3 If a teacher's lesson is cancelled at short notice, the participant, or the person liable for payment, will be informed via WhatsApp. If the participant wishes to use this service, they must provide their mobile number to ADH. If ADH does not have this mobile number, ADH cannot inform the participant of the cancellation. ADH is never obliged to communicate lesson cancellations through any means other than the offered WhatsApp messages. ADH is never liable for the non-receipt of WhatsApp messages regarding lesson cancellations, nor for any consequential damages.
8.4 ADH is not liable for the non-receipt of communications regarding the course and/or lesson, in the broadest sense, if the participant, or the person liable for payment, has not promptly communicated a change of details to ADH.

Article 9 – Participant unable to attend lessons
9.1 Any (possible) inability to attend the agreed lessons should be communicated as soon as possible, by email or WhatsApp.
9.2 If ADH has not received notice, or has not received timely notice (no later than 24 hours before the lesson in question), the lesson in question will be regarded as attended. This does not apply if unforeseen circumstances prevent attendance less than 24 hours in advance.
9.3 Missed lessons may be made up if notice was given on time.
9.4 Each participant may, in consultation, make up a maximum of three lessons at one of the other course times, and only within the current season. Lessons missed due to force majeure take priority.
9.5 Upon registering for a course, ADH assumes that the participant intends to be present at all lessons at the agreed course time.

Article 10 – Use of audio-visual material
10.1 During courses and workshops, ADH may produce audio-visual material of its activities for publicity purposes. The participant or their work may be visible in this material. When publishing audio-visual material, ADH will take into account if the participant does not give consent.
10.2 ADH is not liable for the publication of audio-visual material by third parties other than ADH. The participant or person liable for payment indemnifies ADH against any liability in this regard towards third parties, including but not limited to visitors to the lesson/course or associated event.

Article 11 – Liability
11.1 Participation in courses is entirely at the participant's own expense and risk. The participant is personally responsible for their own belongings.
11.2 ADH accepts no liability for personal injury and/or theft, loss, disappearance or damage to the belongings of participants and/or visitors arising during and/or as a result of attending a course and/or lesson or leaving materials in the studio after a lesson.

Article 12 – Change of details
12.1 Changes of details, for example due to a change of address of the person liable for payment and/or participant, must be communicated promptly by email to bij@atelierdeheerlijkheid.nl.

Article 13 – Privacy of personal data
13.1 The participant/person liable for payment gives ADH permission to record the following personal data in the automated participant database: name and address details, date of birth, telephone number, email address.
13.2 The General Data Protection Regulation (GDPR) applies to the personal data of the participant/person liable for payment.
13.3 ADH uses the data of the participant/person liable for payment in its administration for:
a. Processing the registration of the participant.
b. Execution of the agreement concluded with the participant.
c. Providing information to the participant/person liable for payment regarding the purchased course programme.
d. For marketing purposes, ultimately aimed at improving the service of ADH.
13.4 Within ADH, Marike Boerman and Rick Bomans have access to the personal data of the participant/person liable for payment.
13.5 ADH will not sell or rent personal data to external parties, except when required to comply with a legal obligation.
13.6 Personal data will not be retained longer than legally permitted.


Article 14 – Guidelines for family composition/care situations (primarily applicable to the Children's Art Studio)ADH applies the following guidelines in cases of special circumstances regarding family composition and care situations, such as in a situation involving divorced parents where the participant is a minor:Communication takes place between ADH and the designated person(s) liable for payment. Both parents with parental authority have the right to have their details recorded in the administration in order to receive information about lessons and courses.

Article 15 – Shop and webshop (return policy)
15.1 Applicability
15.1.1 This article applies to purchases of products via the (online) shop of Atelier De Heerlijkheid, including but not limited to paint, pigments, paper, panels, cards and artworks, purchased in the shop or via the webshop.15.1.2 This article is intended for private customers (consumers). Different or additional arrangements may be made for business purchases.
15.2 Online purchases – right of withdrawal (14 days)
15.2.1 For online orders as a consumer, the buyer has the statutory right of withdrawal. This means the buyer may cancel the agreement within 14 days of receiving the product without stating reasons.15.2.2 The buyer notifies ADH by email within 14 days of receiving the order that they wish to exercise the right of withdrawal.
15.2.3 After this notification, the buyer has a further 14 days to actually return the product.
15.2.4 A return is preferably reported via the email address stated on the website by ADH, mentioning the name, order details and the relevant items.
15.3 Conditions for return shipment (online)
15.3.1 The buyer may inspect and handle the product as would be customary in a physical shop.
15.3.2 If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, depreciation may occur. ADH may deduct this depreciation from the amount to be refunded.
15.3.3 The buyer shall ensure that the product is returned as carefully as possible, preferably in the original packaging and with all supplied parts and documentation, insofar as reasonably possible.
15.4 Exceptions to the right of withdrawal
15.4.1 For some products, the law provides no or a limited right of withdrawal.
15.4.2 At ADH, this particularly concerns:a. Custom-made and personalised products: products made to the buyer's specific requirements, such as commissioned paintings or specially mixed paints.b. Products that cannot easily be undone: for example, materials that have been inseparably mixed or processed.c. Workshops and activities on a fixed date booked via the webshop: these are leisure services on a specific date or period; the right of withdrawal generally does not apply.
15.4.3 If an exception applies to a product or service, ADH will make this clear – insofar as possible – with the product and in the order confirmation.
15.5 Costs and refund upon return (online)
15.5.1 In the case of a complete return within the statutory time limits, ADH will refund the full purchase price, including the standard shipping costs of the outward shipment. If the buyer returns only part of the order, the outward shipping costs will not be refunded.
15.5.2 The costs of returning the parcel are in principle borne by the buyer, unless ADH has expressly stated otherwise.
15.5.3 Refund will be made within 14 days after ADH has received the cancellation and the product has been returned, or the buyer has demonstrated that the product has been shipped, whichever is earlier. Refund is made via the same payment method used for the order, unless otherwise agreed.
15.6 Returning purchases made in the physical shop
15.6.1 There is no statutory cooling-off period for purchases in the physical shop.
15.6.2 ADH applies the following exchange policy for purchases in the shop:
a. Unused and undamaged products may be exchanged within 14 days of purchase.
b. Exchange is possible for another product or a voucher to the value of the purchase price.
c. Exchange or return of original artworks and custom work is in principle not possible, unless there is a demonstrable defect or error.
15.6.3 A cash refund for purchases in the physical shop is only given in the case of a defective product or an error on the part of ADH (for example, a wrongly delivered product).
15.7 Defective or incorrectly delivered product
15.7.1 If the buyer receives a damaged, defective or incorrectly delivered product, they should report this as soon as possible, preferably within 7 days of discovery, to ADH and if possible include clear photographs.15.7.2 In that case, ADH will provide an appropriate solution: replacement, repair or refund. The shipping costs for returning a defective or incorrectly delivered product are borne by ADH, without prejudice to the statutory guarantee to which the buyer is entitled.
15.8 Reporting a return
15.8.1 A return notification is preferably made by email to the email address indicated by ADH, stating the name, address, order number, the relevant items and – if desired – the reason for the return.
15.8.2 After the return notification, the buyer will receive instructions for the return address and further handling.
15.8.3 The buyer packs the product securely and returns it using a shipping service of their choice. The buyer retains the shipping receipt with tracking information until the return has been confirmed and processed by ADH.

Article 16 – Accommodation and stay (B&B Atelier De Heerlijkheid)
16.1 Applicability
16.1.1 This article applies to all agreements regarding accommodation and stay (B&B) at Atelier De Heerlijkheid, regardless of whether these were booked directly or via an external booking platform.
16.1.2 For bookings via external platforms, the terms of the relevant platform also apply in addition to these conditions. In the event of conflict, the terms of that platform prevail insofar as mandatorily prescribed.
16.2 Reservation and conclusion of the agreement
16.2.1 A reservation is established once ADH has confirmed the booking in writing (by email or via the booking platform used).
16.2.2 The reservation applies to the number of persons, room(s) and dates as stated in the confirmation. The guest is responsible for verifying the accuracy of the details.
16.3 Prices and payment
16.3.1 The applicable rates for overnight stay, breakfast and any extras are communicated in advance via the website, the booking module or the booking platform.
16.3.2 ADH may request a deposit or require full prepayment. This will be stated at the time of reservation.
16.3.3 Any additional costs (e.g. consumables, extra cleaning, damage) will be settled afterwards, unless otherwise agreed.
16.4 Cancellation by the guest
16.4.1 Cancellation must be made in writing by email or via the booking platform used. The date on which the cancellation was received by ADH applies as the cancellation date.
16.4.2 The following cancellation charges apply, unless expressly stated otherwise at the time of booking:
a. Up to 30 days before arrival: cancellation is free of charge.
b. From 30 to 14 days before arrival: 50% of the total reservation amount is due.
c. Less than 14 days before arrival or in case of no-show (failure to appear without cancellation): 100% of the total reservation amount is due.
16.4.3 In the event of early departure, no refund will be given for unused nights, unless expressly agreed otherwise.
16.4.4 For accommodation and other leisure services on a fixed date or period, the 14-day right of withdrawal as applicable to online product purchases generally does not apply.
16.5 Cancellation by ADH
16.5.1 In the event of force majeure (such as serious malfunctions, fire, prolonged illness, unusability of the accommodation or similar circumstances), ADH may cancel the reservation.
16.5.2 ADH will inform the guest as soon as possible and will – if possible – offer an alternative or fully refund the amounts already paid.
16.5.3 In that case, ADH is not liable for further damage or costs incurred by the guest (such as alternative transport or accommodation), except in the case of intent or gross negligence.
16.6 Arrival, departure and use of the accommodation
16.6.1 As standard, check-in is possible from the time stated in the confirmation and check-out is no later than the agreed time on the departure day.
16.6.2 The guest must use the accommodation and its inventory with care and leave it in a proper condition upon departure.
16.6.3 It is not permitted to have more persons stay overnight than was reserved for, unless otherwise agreed in advance with ADH.
16.7 House rules
16.7.1 A smoking ban applies on the entire premises of ADH, both indoors and outdoors.
16.7.2 Pets are only permitted if this has been expressly agreed with ADH in advance. Additional cleaning costs may be charged for this.
16.7.3 The guest is expected to respect the tranquillity of the surroundings and other guests and not cause any nuisance. In the event of repeated nuisance, ADH may terminate the agreement without any right to a refund.
16.8 Liability and damage
16.8.1 Staying at the B&B and using the facilities is at the guest's own risk.
16.8.2 ADH is not liable for loss, theft or damage to the belongings of guests, unless there is intent or gross negligence on the part of ADH.
16.8.3 The guest is liable for damage to the accommodation, inventory or property of ADH, insofar as this is the result of acts or omissions by the guest or persons staying with them. Damage is preferably settled by mutual agreement and may be charged.
16.9 Force majeure
16.9.1 Force majeure is understood to mean any circumstance beyond the control of ADH which could not reasonably have been foreseen at the time of concluding the agreement and which wholly or partially prevents the normal performance of the agreement.
16.9.2 In the event of force majeure, ADH may suspend or dissolve the agreement without judicial intervention, without being obliged to pay any compensation other than the refund of amounts already paid for nights not yet enjoyed.

Article 17 – Guided tours, group arrangements and events
17.1 Applicability
17.1.1 This article applies to all agreements regarding guided tours, presentations, group arrangements and events at ADH, with or without catering.
17.1.2 If an arrangement includes (elements of) a course or workshop, the other provisions of these general terms and conditions remain applicable, insofar as they do not conflict with this article.
17.2 Reservation and conclusion of the agreement
17.2.1 A reservation is made by email or via the website. The agreement is established once ADH has confirmed the
booking in writing (by email).
17.2.2 The booker/contact person acts as the group's representative and is responsible for communication with ADH.
17.2.3 ADH may request a deposit or require full prepayment. This will be stated at the time of booking. If payment is not made on time, ADH is entitled to cancel the reservation.
17.2.4 If a minimum number of participants has been agreed and the actual number of participants is lower, the fee based on the minimum number remains due.
17.3 Final numbers and dietary requirements/allergies
17.3.1 The booker shall provide the final number of participants in writing to ADH no later than 7 days before the start, unless expressly agreed otherwise.
17.3.2 Dietary requirements and allergies must be communicated in writing within the same time frame.
17.3.3 ADH endeavours to accommodate dietary requirements and allergies but cannot guarantee the complete exclusion of (traces of) allergens.
17.4 Prices and additional costs
17.4.1 The price and content of the arrangement (duration, components, refreshments) are confirmed in writing in advance. All prices include VAT unless expressly stated otherwise.
17.5 Cancellation by the booker
17.5.1 Cancellation must be made in writing by email. The date on which the cancellation was received by ADH applies as the cancellation date.
17.5.2 The following cancellation charges apply, unless expressly stated otherwise at the time of booking:a. Up to 14 days before the start: cancellation is free of charge.b. From 14 to 7 days before the start: 50% of the total reservation amount is due.c. Less than 7 days before the start or in case of no-show (failure to appear without cancellation): 100% of the total reservation amount is due.
17.5.3 If the final number of participants is reduced after the deadline in 17.3.1, ADH may invoice the reservation based on the last reported final number (or the agreed minimum number, if higher).
17.6 Cancellation or amendment by ADH
17.6.1 In the event of force majeure (such as prolonged illness, unforeseen unusability of the location/facilities or similar circumstances), ADH may cancel or reschedule the arrangement.
17.6.2 ADH will inform the booker as soon as possible and will – if possible – offer an alternative or refund the amounts already paid.
17.6.3 In that case, ADH is not liable for further damage or costs incurred by the booker/participants, except in the case of intent or gross negligence.
17.7 Programme, weather and safety
17.7.1 Arrangements may (partially) take place outdoors (e.g. in the dye garden). In the event of weather conditions or other circumstances that (partially) impede execution, ADH is entitled to adjust the programme or (partially) move it indoors.
17.7.2 Participants must follow instructions from ADH regarding safety and protection of buildings, garden, inventory and materials. ADH may refuse participants access or terminate the arrangement in the event of misconduct or endangerment. In that case, no right to a refund exists.
17.8 Alcohol17.8.1 If alcoholic beverages are served, only persons aged 18 and over may consume alcohol. ADH is entitled to refuse or cease the serving of alcohol in case of doubt about age or in the event of undesirable behaviour.
17.9 Liability and damage
17.9.1 Participation in an arrangement is at the participant's own expense and risk. ADH accepts no liability for theft, loss, disappearance or damage to the belongings of participants and/or visitors, except in the case of intent or gross negligence.
17.9.2 Damage to property of ADH caused by (members of) the group may be recovered by ADH from the booker/contact person, insofar as such damage is the result of acts or omissions by the group.
17.9.3 For arrangements and other leisure services on a fixed date or period, the 14-day right of withdrawal as applicable to online product purchases generally does not apply.

Article 18 – Final provisions
18.1 Changes to these general terms and conditions are reserved.
18.2 In the event of significant changes to the conditions, an announcement will be made at least one month before the date of entry into force of the change, by email.
18.3 Until the conditions are amended, these conditions remain valid, unless legal measures invalidate one or more articles.
18.4 In cases not covered, or insufficiently covered, by these general terms and conditions, Marike Boerman or Rick Bomans shall decide.
18.5 These general terms and conditions, as well as any disputes arising from them, are exclusively governed by Dutch law.
